1. Scope
These Terms and Conditions (“Terms”) govern the use of the Lovano platform, including its website, mobile applications, livestream features, communication services, and all related services provided by Lovano.
By registering for or using Lovano, you agree to be bound by these Terms.
2. Minimum Age Requirement
Lovano is intended solely for individuals who are at least 18 years old.
By creating an account, you confirm that you are at least 18 years of age.
3. Registration and User Account
Users agree to:
Provide accurate and truthful information.
Keep login credentials confidential.
Not create accounts on behalf of other individuals.
Maintain only one personal account unless otherwise authorized.
Lovano reserves the right to suspend or terminate accounts that violate these Terms.
4. Community Rules and User Conduct
The following activities are strictly prohibited:
Harassment, threats, or intimidation.
Hate speech or discrimination.
Fraud, scams, or deceptive practices.
Identity theft or impersonation.
Spam or unsolicited promotions.
Illegal activities.
Sharing another person’s private information without consent.
Violent or harmful content.
Pornographic, sexually explicit, or otherwise unlawful content.
Violations may result in immediate suspension or permanent termination of the account.
5. User Content
Users retain ownership of the content they upload to Lovano.
By uploading content, users grant Lovano a non-exclusive, worldwide license to host, display, store, process, and distribute such content solely for the purpose of operating and improving the platform.
Users represent and warrant that they own or have the necessary rights to all content they upload.
6. Messaging Services
Lovano provides communication tools that allow users to interact with one another.
Lovano is not responsible for the content of private communications between users.
Messaging services may not be used for illegal, abusive, fraudulent, or harassing purposes.
7. Livestream Features
Lovano may offer livestream functionality.
Users participating as streamers agree not to:
Violate any applicable laws.
Broadcast sexually explicit or pornographic content.
Display harmful, abusive, or dangerous behavior.
Infringe upon the intellectual property or rights of others.
Lovano reserves the right to remove, restrict, or terminate any livestream at its sole discretion.
8. Virtual Currency (“Diamonds”)
Lovano may offer virtual items or digital currency known as “Diamonds.” To protect the integrity of the platform and prevent abuse, Lovano maintains separate balances for Purchased Diamonds and Earned Diamonds.
Purchased Diamonds
Purchased Diamonds:
Are bought by users through Lovano or an authorized payment provider.
May only be used to send virtual gifts or for other platform functions expressly made available by Lovano.
Have no cash value and are not eligible for withdrawal, redemption, or conversion into cash.
Cannot be converted into Earned Diamonds.
Do not constitute personal property.
Are non-transferable unless expressly permitted by Lovano.
Are generally non-refundable, except where a refund is required by applicable law.
May only be used within the Lovano platform.
Earned Diamonds
Earned Diamonds:
Are credited to eligible creators when they receive qualifying virtual gifts from other users.
Are maintained separately from Purchased Diamonds.
Are the only Diamonds eligible for withdrawal, subject to Section 10 and all applicable eligibility, verification, anti-fraud, and payment requirements.
Cannot be purchased directly or created by converting Purchased Diamonds.
Except for the conditional payout rights expressly granted to eligible creators under Section 10, Diamonds have no monetary or cash value and may not be redeemed, transferred, sold, or exchanged outside the Lovano platform.
Lovano reserves the right to modify the pricing, availability, functionality, or conditions of Diamonds at any time, subject to applicable law.
9. Premium Memberships
Lovano may offer paid subscriptions and premium services.
Subscriptions automatically renew unless canceled before the end of the current billing period.
Users may manage or cancel subscriptions through the applicable payment provider.
10. Creator Program and Payouts
Eligible streamers and creators may receive Earned Diamonds from qualifying virtual gifts sent by other users. Purchased Diamonds are never eligible for withdrawal and cannot be converted into Earned Diamonds.
Subject to these Terms, eligible Earned Diamonds have a gross payout value of €0.05 per Earned Diamond. The minimum withdrawal amount is 2,000 Earned Diamonds.
To qualify for payouts, creators may be required to:
Complete identity, age, tax, and payment-account verification.
Comply with all platform rules and creator-specific terms.
Meet the minimum withdrawal threshold.
Provide complete and accurate payout information.
Lovano retains a 30% platform share from the gross payout amount. In addition, each withdrawal is subject to a 5% withdrawal processing fee, calculated after deduction of Lovano’s platform share, to cover payment-provider costs, bank charges, and administration. A minimum withdrawal processing fee of €1.00 applies to each withdrawal. Where the percentage-based fee is less than €1.00, the €1.00 minimum fee will apply.
Withdrawal requests are reviewed and processed manually and may take up to 30 business days after Lovano has received a complete and valid request and all required verification information. Delays caused by incomplete information, compliance reviews, payment providers, banks, or circumstances outside Lovano’s reasonable control may extend this period.
Lovano may offset refunds, chargebacks, reversals, taxes, penalties, fees, or other amounts owed by the creator against any payout, to the extent permitted by applicable law. Lovano reserves the right to withhold, delay, adjust, or deny payouts in cases involving suspected fraud, abuse, manipulation, policy violations, chargebacks, payment disputes, legal or regulatory concerns, or Diamonds obtained through prohibited or invalid activity.
Calculation clarification
This draft treats €0.05 per Earned Diamond as the gross payout value before Lovano’s 30% platform share and the withdrawal processing fee. Under that interpretation, a withdrawal of 2,000 Earned Diamonds has a gross value of €100.00, less the €30.00 platform share and a €3.50 processing fee, resulting in a net payout of €66.50 before any applicable taxes, chargebacks, or other permitted deductions.
This clarification is explanatory only and should not be published as part of the Terms unless Lovano wants to include a worked example.
11. Privacy
Personal data is processed in accordance with Lovano’s Privacy Policy.
The Privacy Policy forms an integral part of these Terms.
12. Account Suspension and Termination
Lovano may suspend or terminate accounts that violate these Terms or applicable laws.
Users may delete their accounts at any time.
Unless required by law, virtual goods, Diamonds, subscriptions, and other digital purchases are non-refundable following account termination.
13. Disclaimer
Lovano provides a technology platform designed to facilitate connections between users.
Lovano does not guarantee:
Matches or relationships.
Meetings between users.
The accuracy of user-provided information.
Continuous, uninterrupted platform availability.
Users interact with others at their own risk.
14. Limitation of Liability
To the fullest extent permitted by law, Lovano shall not be liable for indirect, incidental, consequential, special, or punitive damages.
Lovano’s total liability arising from the use of the platform shall be limited to the amount paid by the user to Lovano during the twelve (12) months preceding the claim.
15. Intellectual Property
All rights, title, and interest in the Lovano platform, including software, trademarks, logos, branding, designs, and content created by Lovano, remain the exclusive property of Lovano or its licensors.
No content may be copied, reproduced, distributed, or commercially exploited without prior written permission.
16. Changes to These Terms
Lovano reserves the right to update or modify these Terms at any time.
Users will be notified of material changes through the platform or by email where appropriate.
Continued use of the platform after such changes become effective constitutes acceptance of the updated Terms.
17. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the jurisdiction in which Lovano’s operating company is registered, without regard to conflict of law principles.
